Refund & Cancellation Policy

BioRx does not currently sell any goods, digital content or services. All content on biorx.uk is free to access. We take no payments, hold no card details, operate no subscriptions, and issue no invoices.

If you have been asked to pay money to BioRx, or by anyone claiming to be BioRx, it is not us. Please do not pay, and please report it to us using the contact form.

This policy is published in advance so that our terms are transparent, and so that the position is clear to payment providers, partners and readers. The terms in section 2 below take effect only if and when BioRx begins to sell something, and will be updated at that point.

Intended terms if we sell in future

Should BioRx offer paid digital content, subscriptions or services, the following terms would apply to consumers in the UK. They are drafted to reflect the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and the Consumer Rights Act 2015.

1 Your 14-day right to cancel

For contracts made at a distance, you would have the right to cancel within 14 days, without giving a reason. The 14 days run:

  • for services, from the day after the contract is made;
  • for digital content not on a tangible medium, from the day after the contract is made;
  • for goods, from the day after you (or someone you nominate) receive them.

To cancel, you would tell us clearly (via the contact form or in writing to the registered address) before the 14 days expire. You could use the model cancellation form set out in the Regulations, but you would not have to.

2 Refunds

On valid cancellation we would refund all payments received, including the standard delivery cost where goods were involved, within 14 days of accepting the cancellation (or, for goods, within 14 days of receiving them back or evidence of return, whichever is sooner).

Refunds would be made using the same payment method used for the original transaction, unless you expressly agreed otherwise. We would never charge a fee for issuing a refund.

3 Digital content: the important exception

Where you buy digital content that is downloaded or streamed immediately, the 14-day cancellation right is lost if, and only if, all of the following are true:

  1. you gave express consent to the content being supplied before the 14-day period ended; and
  2. you acknowledged that you would consequently lose your right to cancel; and
  3. we provided you with confirmation of that consent and acknowledgement on a durable medium.

Our checkout would present these as separate, unticked confirmations. If you do not give that consent, supply would begin after the 14 days, and your cancellation right would remain intact throughout.

4 Services already begun

If you asked us to begin a service during the cancellation period and then cancelled, we could charge a proportionate amount for what had already been provided. If the service were fully performed within the period with your express consent and acknowledgement, the cancellation right would be lost.

5 Other exceptions

The statutory cancellation right does not apply to certain contracts, including goods made to your specification or clearly personalised, sealed goods unsealed after delivery where return is unsuitable for health or hygiene reasons, and services where the price depends on fluctuations in the financial market outside our control. Any such exception would be stated clearly before you paid.

6 Faulty or misdescribed items

Separately from cancellation rights, under the Consumer Rights Act 2015 anything we supplied would have to be of satisfactory quality, fit for purpose and as described. If it were not:

  • within 30 days of purchase you would have a short-term right to reject and receive a full refund;
  • after 30 days and within 6 months you would be entitled to a repair or replacement, and to a refund if that failed or were not possible;
  • after 6 months these rights continue for up to 6 years (5 years in Scotland), though the burden of proving the fault existed at supply moves to you.

For digital content, you would be entitled to a repair or replacement, and to a price reduction where that were not possible, plus compensation for damage caused to your device or other digital content by content we supplied.

7 Subscriptions

Recurring subscriptions could be cancelled at any time through your account or by contacting us. Cancellation would stop future payments; access would continue to the end of the paid period. We would send a reminder before any renewal, and we would not make cancellation harder than sign-up.

8 Chargebacks and disputes

Please contact us first. Most issues are resolved faster directly than through a card issuer. We would respond to any refund enquiry within 2 working days and resolve it within 10 working days. Nothing in this policy affects your right to raise a dispute with your card issuer or payment provider, or your statutory rights.
